Statutory declaration - proof of being separated

Hi, can anyone help with my problem?

I've been separated (but not divorced) for 2 1/2 years and student finance have asked me to give evidence in the form of a statutory declaration as I have not got a decree nisi.

Can anyone tell me where I can get one and what it should say?

Can I type if myself and ask a professional (solicitor, teacher, priest etc) to sign it?

  • I believe you can make a statutory declaration at your local magistrates court, or before a solicitor who is registered to act as a commissioner of oaths.
    I think the format is similar to the following, however I'm not a lawyer. I guess the best thing to do would be to phone your local magistrates court and ask what you would need to do (they may have pre-printed forms) and what the fees etc are.
    Statutory Declarations Act 1835

    I (name) of (address) do solemnly and sincerely declare that:

    (Specify the matter to be declared)


    And I make this solemn declaration conscientiously believing the same to be true, and by virtue of the provisions of the Statutory Declarations Act 1835.

    Dated the (date) (Signature of the person making the declaration)


    Declared before me (Signature of the Justice of the Peace)
    Justice of the Peace for the County of (Specify)
