    Story doesnt ring true to me. You may say that you moved in on xyz, however, my guess is that you actually moved in well before that and someone knew that. Few people notify the day they move in, or their intent to move in together and then time passes, they know what they should be doing, but delay doing it. It is still fraud.

    I also feel that on the balance of probabilities my partner may look guilty, however proving this beyond reasonable doubt in a criminal court the council and DWP will probably struggle, and I'm wondering if they're just happy for us to pay back more than we actually should be, rather than taking us to court and the true amount would probably be proved to be significantly less.

    I cant give too much away on the details, as I've been advised that DWP and council fraud staff monitor these forums, but I was wondering if it would seem that this is all finalized or is it likely to still go to court?

    I got free legal advice, and they said it would likely be because of your circumstances that they havent prosecuted, we have a disabled son so I was thinking that could be the reason maybe. Also we are on a low income.

    We need closure, having been really worried about it from dec 08 through to now, and not knowing what the future holds. I have started to think less and less about it over the last year, but with the PM banging on about benefit fraud recently it's bought it all back to us.

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

    The whole point of my post has been completely lost, I asked if it is likely that my partner will still be prosecuted, nearly 2 years after not turning up to IUC, no caution, admin penalty or prosecution has ever been talked about since.

    I have even been re-reported for benefit fraud by some joker on this very thread! even though the DWP are fully aware of this hence the whole point of my post, what a fool.


    It was my belief that I would find a few people with the compassion or decency to be sympathetic and try to offer some guidance or advice, however I;ve been treated like the witch in the village!!

    I thank the odd one or two people that have been constructive in their advice, and I will draw a line under this one.

    People would choose to report these kinds of things because they fear 'revenge attacks'.....pretty much like the ones you are threatening now.

    What on Earth do you want to ruin someone elses Christmas for who have nothing whatsoever to do with this situation?
    You 'think' you know who sent in a letter and you not only want to get revenge on her...........but you also want to ruin her Mum and Dads Christmas too??? And you would do that even without knowing that the facts are correct!???

    What a very mean and spiteful person.

    Are you really so surprised as to why forum members have responded to you like that after the things you have said and done?

    And, as you did when the whole thing started with the DWP, you run away, burying your head in the sand when things dont run the way you hoped.

    I can't make head nor tail of most of it. Now I know I'm in the middle of a flare up with my disability which can make me 3 sheets to the wind but even so...........................(confused smiley)
