Does EA have to pass on all offers?

Sent EA an email today setting out my offer on a house, detailing fact I am a cash buyer, reasons for my offer (ie. similar house in road just been sold).

Got email back to say my offer would be too low as they had one near the asking price but this had been refused but she would notify the vendor of my interest and let me know if there was a change.

When we viewed the girl said they had had only one offer but had refused it as the people wanted to rent the house first (presumably because they hadnt sold theirs yet).

From EA's reply it sounds to me as if she hasnt passed on my offer and reasonings to the vendor.

Do they have to pass on all offers, what can I do next?

I did send her back an email saying that the previous offer had rental implications so not just a simple cash offer like mine and stressed that I wanted them to know I was a cash buyer and that a house almost identical to theres has just sold in the same road for x.

Any advice welcome on my next step

    It depends what instructions they have from their clients (the vendors). If the vendors told them not too pass on offers below £X, or below any previous offer, then that's what the agent will do (or rather, not do!).

    If no specific instructions were given, they should pass on all offers. But to be sure, put your offer in writing, not email.
  • I put in a really low offer on a house and they did not pass it on to the people selling.

    How do you know this? Maybe they felt insulted or didn't take it seriously so felt no need to respond.

    Send a copy of your letter direct to the vendor, if they are still living at the property.

    The way I read the codes of practice, the client's instructions to reject offers don't just have to be couched in monetary terms.

    The seller may have instructed the EA to reject all verbal offers, or all offers tendered by e-mail, for all you know. However - if your offer is rejected because of this, don't you think the EA would tell you?
