Hi andyandflo. The word "and" isn't quite right. The reason for selling must be in order to continue occupation. If selling and continued occupation are merely coincidental, that isn't enough.

A number of legal authorities ("Upper Tribunal") have made it clear that in order to fall within the exception, a claimant / partner must have taken positive steps to look at alternatives to selling the property. In other words, if selling is the only option that has been considered, it is more likely than not the exception won't be satisfied.

Absolutely!! I agree that your wording is spot on. And I would be surprised that people would not consider other options first. Mind you nothing really surprises me any more!
