I don't want another contract !

  • Tell them as said before you are now on statutory periodic. They cannot insist on a 6 month contract to be signed....It is probably the LA that is keen for you to sign as most charge the tenant and LL a fee for the new contract. As it stands your previous contract is still valid albeit that you have reverted to statutory periodic automatically and notification is as per this.
    A LL would be daft to serve you a S21 as this just means they will incure the extra costs (which is in the favour of the LA)

    If the LL wants to increase the rent he can do so by following the correct procedure. See here.

    But try speaking direct to the LL (not the agent). He may prefer to keep a reliable, paying tenant at the current rent rather than evict you or have you leave and lose money searching for a new, possibly unreliable tenant.

    I think it would be stupid to kick me out (the property is not in a great condition, so it's not that easy to rent and I have been a good tenant, payed on time , had only a problem with a cooker that stopped working and they have repaird in almost 3 weeks :( ).
    But if they would really want to, if they give me notice I will leave ... because they just annoyed me with assuming that I am stupid and that if they say that you HAVE TO sign, I will sign without asking anything...

    I think the LL it's a company ... so they probably care only about getting their money on time.

    The same applies to a company. They'd usually still prefer a guaranteed rent from a reliable tenant than all the costs involved with eviction. Stop worrying. Don't sign a new contract, and 10 to 1 this will all blow over.

    Oh, I got your point precisely. You need to get the tenancy to go 'statutory periodic'.

    Hi Mess0804

    This is what is happening to me. (See contract changing) My yearly contract was expiring and the LA wanted me to sign another contract, I wrote and said, I was happy for the contract to become periodic. They telephoned quite angry, insisting that the owner wanted a fixed term tenancy, i.e. the assurance that someone would remain in the property. Course, its all gone to pot now, as the owner is not playing ball with them and wants a 2 month break in 6 month let. They didn't send the new 6 month let to me until 26 August, I signed and sent back, I don't think the LA signed and now with the bank holiday my lease has now expired and I believe that it is now periodic, due to the time they have taken.
    I found out yesterday from another owner, who also used the same agency that she gave permission quite happily for the tenant to have her dog. But the LA wanted £150 extra deposit. The owner told LA, this was not necessary. If the owner and tenant had not been communicating directly, the owner would know nothing about this. I think it is a good idea that owner's do speak privately to tenants about hidden charges, that they know nothing about.
  • To paraphrase someone on "Our drugs war" from channel 4 : The first rule of being a smuggler and a letting agent is to prevent your client and supplier from directly contacting each other, if they do they no longer need you.
    LA will charge what they can get away with for "preparation of a new contract" ie photocopying it and writing new dates in the blank spaces. Some charge both landlord and tennant for that service.
