Bought ebay item but remote not as described and range poor...

  • OK well I sent the following response:

    I am referring to the terms of the Sale of Goods Act, under UK Law. You have provided me with a product that (a) is significantly different to that described and (b) doesn't function properly. This is your liability, therefore you must pay the return postage costs. This is British Law and is applicable to this sale (as per the help pages), so either you abide by this or I will escalate to PayPal for resolution. I look forward to hearing from you. cc-uk

    The seller then responded with this, trying to make it look like I'm complaining about the reception when I am clearly complaining about the remote!
    I have offered the buyer the ''remote'' he was referring to and his claim that this item is not working is false - this is a USB DVB-T Freeview receiver and he should have checked his postcode before buying because the only reason this item is not working is because FREEVIEW is NOT available in his area!! Please check https://www.freeview.co.uk and enter his postcode. My previous offer of providing him with a refund, upon returning the item, is now retracted. I clearly state within my listing to check freeview reception in your area before purchase - he clearly did not do that!

    Please Help Me - I can't contact PayPal now so how do I put across that it's the range of the remote that I'm complaining about?

    This seller is clearly a con-artist. :mad: Please advise me I'm so angry about this :mad:

    You need to send a picture, if possible of the remote shown on the ebay site(picture in original post) and also take a picture with your camera of the remote you recieved from the seller. You also need to clearly state that the items are not as described and this is why you want a refund and NOT because of the reason that the seller replied with in the above thread!

    She says she offered me the remote but apparently I declined - I said I wanted a refund. I'm concerned that PayPal are just going to give it a quick glance and agree in her favour because a lot of peeps on this ebay board seem to have had that problem :(
