Notice of dissasocciation from family member with an IVA

18 Years ago my husband and I very naively went into a three way mortgage with my mother in law, as on paper we could not afford the payments. She has never contributed to the mortgage.


Last year her debts came to light and she admitted she could not afford to pay them although we gave her over a thousand pound to help her out at the time, this only paid off the late payments.

The decision was made that she obtained an IVA to clear her debts of over £30'000



Last week I tried to re-negotiate my mortgage with a small amount of additional borrowing. It was declined due to my mother in laws IVA as there is a 'link' between us with the mortgage.



I have now been told that the best thing to do is to have her name removed from the deeds of the house and get a 'notice of disassociation' to sever the link.



I am in the process of removing her name from the mortgage and the deeds of the house, but I am really confused around the 'disassociation' part.

I cannot seem to talk to the credit reference agencies. Do I need to get a credit report from each of them and then challenge the results, or do I just need to phone them? I tried to speak to someone at one of the companies and they said they couldn’t talk to me unless I had a reference number from their website, which I can’t get unless I sign up with them, and pay a fee.

Or, is there a Company out there somewhere that I can write to who will do this for me. I have spoken to a solicitor but he wasn’t much help to be honest with you.

Any help, advice or ideas will be gratefully received as I am at the stage where I feel very concerned about my financial future because of this.
