Urgent help for a Friend on Renting!

Hello fellow savers,

A friend of mine was given 2 months notice to look for a new house by her agent. She was given a deadline of September 30th. It was a rented accommodation.Initially she paid a deposit to the agent. She has now got a new apartment and to move in september 1. She informed the old agent that she will be moving on that day but the agent is not happy. That old agent want prefers she stayed till the very last day (30th september) for his own financial reasons.

What right have my friend?

Can she get her initial unused deposit back?

Is it a crime for her to move early afterall the agent ask her to move?

    Nope, long as she isn't contracted to the end of September he can do sweet F all.. She should be able to take her deposit and run.

    when did she last sign a tenancy agreement and how long was it for ?

    ... And did she give him a months notice that she would be leaving on that date? Otherwise how is he to know the property would be available to let(or whatever) a month earlier than expected?

    I'm sure someone with the legal knowledge will advise on whether this is a coutesy or requirement.

  • The legal knowledge is dependent on whether the notice was issued to coincide with the end of a fixed-term or the OP's pal was on a periodic tenancy, which is why Clutton asked her very pertinent question. Without some more information sensible advice cannot be given.

    The agent has agreed to give her her deposit once the condition of the house is spot on.

    Good.

    Having to get the house spot on rings alarm bells.

    Get her to read some threads on here about deposits so she is clear about protection of the deposit, wear and tear vs. damage, etc. so she will be in a strong position to deal with this.
