Been sued over car accident

Hello,

I'm new to the forum, so I so sorry if this is in the wrong place, i just really need some advice! My friend was in a car accident 3 years ago, where she ran in the back of someone at low speed.

She has now received a letter from a court saying that she has to pay court costs for a recent claim made by the driver of the other car for injuries. Now my friend has never recevied any other paperwork to suggest that this court case was happening! Can they do this without hearing her side of the story first and without notifying her?

any advice would be so welcoming! thanks!! :)

    Tell her to contact her insurance company.

  • she isn't with that insurance company anymore, will that matter?

    i doubt it would matter as a lot of people switch insurers every year, yet someone can claim for injury (i think) upto a certain number of years after the accident (3 years i think, but more for minors)

    Send the documentation to the insurance company who she was insured with at the time. Phone them immediately (when they are open) and inform them of the details so they can start working on the claim immediately.

    Is it actually a judgement from the court, or just a "Claim Form"?

    as above pass to the previous insurers as she was insured at the time with them.

    Nope - there would have been a file on it from when she first reported the accident.

    Claims can often take months.years to settle. She should speak to who ever was dealing with her claim initially when she reported it.

    First question: did she report it to her insurer at the time it happened? If not, she may have problems getting the insurer interested.
    42 years of experience in the insurance industry.
    And nothing the industry tries do to us surprises me any more!
