You are so close to being suspended now due to seller breaches/warnings that I would suggest that trying anything clever at all to get round ebay rules will be counter productive if it just means you lose your account.

As for herbal life, if they say you can't sell it then don't. Ebay cannot over rule the wishes of a company and if Herbal life get nasty about this it will cost you money.
