Damaged Item

A buyer states an item was recived damaged, wants compensation from me for this but refuses to return this alledged damaged item to me to support my Royal Mail Claim for damaged post.
Is he trying it on, states UMD Disc was in 3 pieces when delivered but can't provide evidence of this.
Now I protected myself and sent it Recorded Delivery now he just wants to quote he has a legal department at work and isn't afraid to use them.
Surely if he starts any action, Paypal, eBay or Small Claim he would have to return the item to me, I have sent the following offering a refund.
What can i do if he just ignores this offer of a refund and goes off and starts something on his own back, should I send a Printed Copy of this, Recorded Delivery giving him 7 days to return for a full refund of the amount he paid a whole £8.39 or the case will be closed.
Any help is always appreciated.

I HAVE HAD ENOUGH OF THIS, YOU STATE YOU WANT TO FORGET ABOUT IT, YET SEND ME TEXT MESSAGES OF COURSE I WILL REPLY.
So,
If you want a refund through Paypal for the amount paid of £8.39, as I would expect if I was in your situation, I will happily process this for you, as this situation isn't worth the hassle over a PSP game of £5.99.
Check with your legal department but they will tell you, you obviously have to return the damaged item 1st. This is a pain yes, but has to be done.
If I don't hear from you within 24 hours I will consider this matter closed and you will have no comeback on me for any refunds.
I have taken every opportunity to cooperate on this matter, but am confused why you won't cooperate with me.

wait and see what he does - if he puts a claim in to paypal, then tell them what you have said to him and send the email you sent him and inform them you wish the merchindice back first. Do watch it that he has not made a copy then smashed the original disk and sending it back to you (though he has to pay P&P on return which isnt much)Never do things tomorow when you can do them today.0
