Can I Sell Herbalife On Ebay???

Firstly, I'm new to this site, so apologies if I've put this thread in the wrong place!
I wondered if anyone could tell me actual law or regulations about selling Herbalife products on Ebay?
I have feedback of over 1000 and have been selling for years, but I recently listed some unused Herbalife products (leftover from my diet... I've never been a distributor). The first auction was closed because I'd copied a stock photo off a Herbalife website. The second auction was closed because I was selling 'non-UK' items (I had found another less-well-known photo which must have actually been showing a non-UK version of the product). I then listed the auction without any photo. It was left to run it's course, but I've received a letter this morning from Herbalife asking me to stop selling their products.
I am rather angry that Ebay have passed on my name and home address to an outside company rather than dealing with the issue themselves, but I also find the letter rather irritating. It says '...Herbalife prohibits the sale of it's products through Ebay' and '... we ask that you discontinue sales of our products'. It does not actually state any laws that back this up, and it does not suggest what action will be taken if I don't comply. I twice made alterations to my auction to comply with their requests, and it seems Ebay are happy with that but Herbalife are making a last ditch attempt to stop me selling my few remaining products.
Can anyone tell me whether I am actually breaking the law if I continue with my auctions? There are loads of Herbalife products being sold on Ebay, I can't think that they really have any power to stop these auctions!

Ive done alot of googling and find no reason who you have to be an official distributor to sell the products, further more nearly all distributors make a loss as its pretty much a scam - http://www.cockeyed.com/workfromhome/epilogue/unsuccessful/unsuccessful2005_2.html

Ebay can however cancel auctions for any reason, so long as they refund you the costs.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Just wanted to say thanks to DarkConvict for researching this for me.
Firstly, I've only bought products for dieting, and I've only bought them through Ebay on principle (they are so much cheaper on Ebay, I resent paying a distributor so much more!). I've gathered that it's not a successful home-business, so won't be doing that... I just want to offload my few remaining products having given up on the 'miracle' diet (which I found to be a load of cr*p). As you say, Ebay can cancel auctions... which they did, but I corrected the issues they cited and Ebay now seems happy... but Herbalife now send me this letter saying 'Please stop selling our products'!!! That's what's annoyed me so much! After years of selling hundreds of other items, it's the first time I've been contacted by a company and told to stop selling!
The stupid thing is, their letter says that only Herbalife Distributors are allowed to sell their products... but also that they prohibit the sale of their products through Ebay. So there shouldn't be ANY Herbalife products on Ebay! So why have Ebay not put a check for the word 'Herbalife' (as they have with designer names and ivory products)?
I think it's likely that Herbalife don't have a leg to stand on and I'll just carry on with my auctions, but thought I'd better check anyway!0 -

I realise my response is a bit out of date but I thought it important enough to post so if it helps, great.
You are right, it is Herbalife policy not to allow sales on ebay. The main reason being that the products would be sold without the support of a personal wellness coach (or as you mentioned, an independant distributor).
The coach's role is to ensure that the customers get the most amazing results and that can't happen if products are randomly bought online without advice & consult.
Verityonline - it would be interesting to know the results of your wellness evaluation, your lean protein estimation that were done prior to purchase and the effect that had on which of the many Herbalife products you used?
Like anything in life there is the right way to do it and the cheap way. The cheap way inevitably has key components missing and its unfortunate no one was there for you to highlight the importance of the coach's role. Its sounds like you spent a bit and got nothing rather than spending abit more and getting something, which is a shame.
My wife, my kids, my parents & I have had life changing results not only because they are great products but because we had the support of a fantastic coach who had our best interests at heart, resulting in my increased energy and reduced lethargy, my wifes weight loss and my mums diverticulitus being brought under control. My kids are far more aware of great nutrition as a results and want to be like Lionel Messi in the future!
What I do know is that some of the stock available for sale via ebay and similar sites is being sold either by customers who have had no support, coaching or guidance (and thought it was just a "miracle diet" having bought it online) or most of it by distributors who joined the business thinking it was some sort of get rich quick scheme (or ponzi) but have realised there is work involved and are trying to recoup there un-researched investment.
Herbalife are working tirelessly to restrict and stop such online sales which would never happen if people understood that when joining a business it involves "doing business"! There is no such thing as get rich quick. As with any business, if your customers are looked after, get great results and you work hard, you will do well. Hence why I have since become a wellness coach.
It is those other misconceptions which give businesses a bad name hence I wished to point them out.0 -
