Vehicle Ownership Help

Options
Hi All, wondering if anyone can give me some advice on this

I purchased a 50cc scooter and it was kept in my parents garage for a while and placed on SORN. After my partner got a provisional license we found a local instructor and booked a CBT, which was unable to be completed on the day due to things running late, so the scooter was left with the instructor. After this my partner became ill and was unable to continue, the instructor said it would be okay to keep the bike there until things were better.

During this time we moved house and said to the instructor there were still health problems and he said he is okay to look after the bike still and without charge. i said let me know if it becomes a problem. I tried to periodically call to check it was still okay but could not get hold of the instructor until recently and he said he has re-registered the bike (in the house move I forgot that we had to re-register the bike and as I only recently SORN’d it I thought I had taken care of it) He is now refusing to hand it back saying it owes him too much money for storage, even though he said he would look after it for free.

Can anyone advise where I stand on this? I have the original bill of sale from when I purchased it and the V5 which is now not valid. And as I never agreed to sell or transfer the vehicle the instructor does not have any documents to say I did,

If anyone can offer any advice it would be most appreciated

Thanks

How did he register the bike in his name?

He cannot get a V5c in his name without the existing V5c holder knowing.

You must've approved that transfer, one way or another.
  • Hi, thanks for the reply.

I forgot about re-registering the bike to the new address when I moved. DVLA will issue a V5 if no reply to a letter of Change of owner. This was his idea of contacting me to be had a problem holding the bike for me.
  • Name and Shame this dodgy bike instructor!

Also I wouldn't of pushed my luck by expecting him to store it for free for what sounds like a long time. You should of arranged for it to be "sent back" when the heath issues started.
