If that term is in your tenancy agreement then sadly yes it does. The LL has no legal obligation to keep the fridge in repair (in fact, they are specifically excluded from the LL's legal obligations). The fridge is on you I'm afraid. You are, however, under no obligation to provide any sort of "upgrade" to the fridge (ie a new one) so you could look at freecycle / local ads for a very cheap second fridge and then get permission from the LL, in writing, to bin the old one.germanjulian wrote: »What does the below mean?

The important thing will be whether the fridge and sofa were actually supplied by the landlord, or whether previous tenants left them and you were welcome to use them.
If supplied by the landlord, that clause seems a bit iffy.
It may just be a badly worded way of stating that the latter is the case. I just moved out of a rented flat and left my washing machine behind (with the agreement of the landlord) as we were getting a new one for our new house. The washing machine is only three years old and works fine. The next tenants will be told they're welcome to use it but it's not supplied by the landlord so as and when it packs up they will need to repair or replace it.
The first place I rented had a fridge and sofa someone had left which were provided on the same basis.0 -

The recommended temperatures for the safe storage of food are to do with the prevention of bacteria growth, not the longevity of your food! I'd argue that in the modern world, a working fridge is essential.0 -
What did you inventory say when you moved in?
That was your chance to point out that the sofa was manky, fridge appeared broken, to take photos as proof etc.
If you missed out on that then I think you are sadly out of luck
Best chance would be to speak to your local CAB as mentioned to check out that clause - i suspect its legitimate as it does offer the inventory as a way around it, so imo it would be a reasonable term.

the inventory does say "fridge working; and sofa is in a bad condition" but as the lady nor I sat on it or smelled it or put a thermometer in the fridge to check the temperature it was a bit hard to point these things out on the move in day.
Lets wait and see... obviously the lady dealing with me is out of the office today... again.0 -
