Drink Driving whilst disqualified and crashed!!

Not me - but a stupid stupid friend of mine was on a ban for drink driving (5 years) and stupidly bought a car from someone at a pub!!!!!!!!!!!! Then proceeded to get into it and drive drunk!

We are all absolutely livid with him! Stupid is not the word - but the only word I can use on here!

We (his "friends") are wondering what kind of punishment he will get. On his bail sheet it says

1. Driving whilst under the influence of alcohol
2. Driving whilst banned
3. Driving without insurance
4. Common assault (battery). Apparently he hit the guy who crashed into him!

He was on a tag for driving whilst banned 12 months previously!!!!!


Any ideas what he will get?

    I think the book is possibly going to turn into a library

    5 years on a DD ban is as I understand it an indication of a repeat offender (1-2 years is normal for a first offence).

    Given the aggravating factors (multiple DD offences, driving whilst banned and violence) I'd suspect a prison sentence to be likely, and possibly the ban to move towards the maximum allowed (another 5 year ban?).

    May depend on what happened to the guy he hit, was he badly injured?
    I've given up trying to get my signature to work with the new rules, if nobody knows what the rules are what hope do we have?

    Not long enough.

    In my mind there is no difference between someone going out with a knife in their pocket and drunk driving - both are offensive weapons.

    I would say along time

    Driving or attempting to drive with excess alcohol 6 months £5,000 Obligatory 3-11


    Driving when disqualified 6 months £5,000 Discretionary 6

    Driving without insurance N/A £5,000 Discretionary 6–8

    Common assault 6 months

    So going on this up to max 15k fine and at max 1 and a half year in jail if they run concurrent, not sure if uk does run concurrent
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    If he already has a 5 year ban, I suspect he has more than one previous drink driving conviction.

    I'm not an expert (I've seen quite a few similarish cases through working in Insurance), I suspect he will get 3 to 6 months
  • Yes 2 previous drink driving offences! which we have just found out about and he has been in jail before too which we have also just found out about! Here was us trying to "help" him deal with having to go to prison!

    Some people never learn. I'm going to put my money on a 12 months sentence. Get a good solicitor...a very good solicitor!! Actually scrub that get a solicitor that knows a good barrister and opt for a crown court trial if possible.
