Health Club withdrew membership benefits

just a quickie.

We are members of a leisure club which is ultimately owned by Bourne Leisure. (its at a Warner Leisure Hotel)

When we signed up to their "platinum" package we were told(its in writing) that we would be entitled as a couple to a treatment voucher worth £25 each, every month. With just 1 working day til the start of next month we have been told they are stopping this, and members will no longer get the vouchers. Effective immediately.

What line of action is open to the members ? They have all signed up to get the vouchers and now told they are not getting them. Not so bad for me i guess, as i pay monthly and shall just stop my payments from now, but many people have paid for a year in advance.

Have expressed my displeasure in writing to the Leisure Club, and emailed customer services at Bourne Leisure, along with each of their directors....

Can we go down the lines that they are in breach of contract and if so what action is open to us, and how do we do it ???

    This could cause problems if you signed up to a 12 month membership. Or are you on a monthly contract?

    This would normally allow you to cancel your contract as they are making unilateral amendments, but you would have to check the t's and c's of your contract.

    Make sure that you send in a cancellation in writing by recorded delivery as cancelling your standing order will not cancel your contract and you will still be liable for the payments that you miss.

    Going in feet first......the membership packs still list it as a benefit........and nothing in the T&Cs says they can withdraw anything !
    Quite simple if im not getting what they promised me im not going to pay. They can try and take me for non payment, but i wont lie down quietly ;-)

    Well if the t's and c's do not state that they can withdraw the services then you have grounds to cancel. As i said before, do this in writing be recorded delivery.

    If you do not advise them, but instead just cancel the payment, you are still in contract with them and they would be within their rights to take you to small claims court (and you would be very likely to lose).

    Don't even think about cancelling the direct debit!!

    BEFORE you do that, write them a letter (sent recorded) stating what you are doing and why. THEN cancel it.

    Otherwise you can shout and scream all you want when they attempt to pursue it, but you'll struggle for evidence to prove your case!
