Someone hit my car - now they deny it. Help!

Back in January when we had all the bad weather, someone ran into the side of my car. He left a note which i didnt see for 2 days, but I called him and he apologised / admited the accident and sent me a text message with his registration details etc.

Roll on to now, and after trying to renew my insurance, i was advised that there was a fault claim against me which was pushing my premiums up. Turns out the guy hasnt contacted his insurers at all (and apparantly wont) and is denying any knowledge of the accident. I have spoken with my insurers (Direct Line) who have tried to contact him, but no joy as yet.

I was just wondering if there is something I can do? Or if he choses not to advise his insurers at all if I just have to deal with it?

Any advice appreciated!

    Do you still have the note? If he wrote something like:

    Sorry I hit your car, please contact me on xxxxx, Richard

    that could amount to an admission.

    I would have thought that the note and the text were an admission of guilt. Also if you do have them, couldn't you report them to the police, for leaving the scene of an accident?

    The details you have been given by the person who hit you may not be actually his, but an assumed identity.

    Thus the guy is denying all knowledge correctly, cos it wasn't him! (If he did write the note, he would know denying it would soon be proved otherwise)

    Insurance companies use a national data base, your insurance company can find out who his ins company is.

    If you have his details and an admission he can get into trouble for not informing his ins. company

    Your insurance company needs a billocking or a kick up the backside to get things moving.

    Thanks for the info. My insurers have already been in touch with his, they know exactly who they are, but Direct Line are telling me that unless he inorms his insurance company off the accident himself there's nothing they can do??!

    Got a feeling i'm being fobbed off here and they just can't be bothered to chase the claim and want to take the easy route.

    I dont have the note the guy left when he hit me, but I do have the text message. He lives somewhere close by and I was considering knocking on his door to confront him. Is it worth it?

    Its just so frustrating!! :mad:

    That is correct, and they have been using that cop out since I started driving (which was many moons ago).

    How big are your gonads?

    If you are going to start something then you need to be prepared to see it through.
    Legal arguments aside about how knocking on someone's door can be interpreted, are you prepared for the possibility that you could be knocking on the door of someone like Kenny Noye?

    Do you have legal cover with your car insurance? If so then you should probably make use of that and phone the legal advice line that usually comes with the cover. They will normally start sending legal letters to the other insurer/3rd party if it sounds as though it was their fault and their trying to wangle out of it.

    I can't believe that just by not informing your insurer of an accident lets you escape scott free ?!

    My mums car got hit by a moped years ago. The moped owner didn't bother to fill in a claim form and until he did, his insurers wouldn't deal with our insurers. So we had the car repaired and paid the excess. Then we issued court summons against the moped owner. It's amazing how quickly he sought protection from his insurers faced with a court summons and a potential bill of several thousand pounds!

    Thanks for your help! I knew there was a reason I paid for legal cover on my insurance, will give them a call and see if they can do something.......
