Im unsure it falls into any catagories of fraud . However I could be wrong , it may be fraud by false rep . Because you have the address , the police will take it up as they have a line of enquiry or need of service , unfortunatly if they get no where you may be looking at a small claims claim. However as the items were sent special delivery , if he has proof of posting we are now looking at a claim from royal mail as it it could be classed as theft in transit or theft of post . IE he posted it at postoffice a tracking number blardi blar , it was picked up by postman nick given to postman susan and never seen again.
I think the seller may have covered his back with the special delivery to behonest but I could be wrong . They should either reinburse you the funds or give you the tracking number and look at filing a claim against royal mail your self.ONE HOUSE , DS+ DD Missymoo Living a day at a time and getting through this mess you have created.One day life will have no choice but to be nice to me :rotfl:0 -

OP says tracking number was false. Not sure what means they went to find this out but if its the case, i dont believe they'd have any case against royal mail as no contract has been entered and even if it has been posted, its usually the sender that needs to claim as it is them who entered into the contract with royal mail.You keep using that word. I think the parcel has never been posted as he gave me a false tracking number and now his phone is going straight to voicemail,he also said on Monday he would refund my money and he said just to pay him when I receive the phone but no refund was ever received.0

Your completly right , It would be fraud by false rep. As long as the police can find him and he lives t the address , not just uses the address you will have a case. The reason they have taken it is that you have an address . If you didnt have that you wouldnt have had a cat in hells chance.
Fraud leglislation changed this year , as the police have to have lines of enquiry and the fraud type has to be one under Home office counting rules that the police can record .

Thanks dizzybuff, the police called me back today to say I would need to go down the MCOL line but surely they should investigate further as this is fraud by false rep, should I ring the police back tommorrow and press the issue with them?0

Did they give you a crime number or say they wont be recording it . I would rinf to find out what they actually did . If their enquirys have drawn a blank they should have recorded it .
Justa question , which force did you report it to ? Your force or the offenders home force? As they had lines of enquiry the crime should have been recorded on the offenders suspected address. If enquirys drew a blank this crime would be Written off and a crime recorded on your home address.
If a crime was not recorded , ask whos decision it was and why .

I reported it to my local non emergency police number so humberside, think I will have better luck with the sheffield police? I have a crime ref number but the chap I spoke to said he thinks I should go down the MCOL route, I felt a bit palmed off by them.Shoud I call my police force back or report as a new crime to sheffield police?0 -
there is a classifieds section on there were you can buy sell electrical items with other members and is very safe due to the popularity of it
Thought I'd quote this. The popularity of a classifieds section and of the forum itself is certainly not a reason to say it is safe, in fact I would say the busier a forum, the higher the chance scammers will create accounts to rip people off. I'm a member of a very popular forum for exotic pets. We've had more and more scammers over the last few years as the popularity of the site grows and grows.0 -
Since I purchased 2 phones before from him I thought he could be trusted, joeyboy is it Reptiles Forums as I've done some digging with afore mentioned scammer and he is a well known member on this site, I've joined it and pm'd him but no response as yet he seems to use the same username and abit of googling goes a long way.

Going to report to Sheffield police on Tuesday as that's the fraudsters home town, humberside police said they will take a line of enquiry, also going to do MCOL on Tuesday. Get all angles covered. I also feel like camping outside the guys front door or sending a few heavies as I have his home n work address0
