I guy in our county was in dispute with a customer and took matters into his own hands him and his son I think were on roof throwing roof tiles down. He got arrested when he eventually came down and probably facing criminla damage0

Possibly, but have been given 6 weeks notice and the builder calling and informing the police of the action they were taking, I'd figure there's far more to this case than we're being told (from both sides).
What is interesting is no arrests have been made.
I've always wondered where fitters stood on this.
A couple of my customers have been at the stage of removing granite for non payment, both stopped at the last minute with payment in full by the customer.
There are a lot of chancers out there (from either perspective).0 -
As the work is/was still in progress, then I'd say that the materials belong to the builder unless paid for, or unless fully incorpporated in to the house so can be removed or demolished. The issue would be the process of getting onto the site to remove/demolish them, as the homeowner could refuse access and that is where the builder could fall foul of the law0

If the builder has chosen to demolish all work carried out by themselves then surely they must hand over every penny that they have taken from the home owner as they haven't done any work at all. They built an extension and then knocked it down so in effect no work has been carried out and they have no right to take money. Furthermore as they are claiming they own all the materials they should remove all the rubbish from site immediately or I'd hire the most expensive skips I could find and charge them for the hire. I'd then prosecute them for trespassing and causing criminal damage to my property (the original house not the extension).0
