What are the solicitors calling themselves? It is easy to check whether they are a separate firm or working in house. You can PM the name if you don't want to put it on the forum.0

No problem - it's Aplins - Aplin Stockton Fairfax.******** Never be a spectator of unfairness or stupidity *******"Always be calm and polite, and have the materials to make a bomb"0

They seem to be a separate firm and their website is here http://www.aplins.co.uk/index.php
They do debt recovery, but the first thing I would do is contact them using the website details and check the letter actually came from them. I would also only contact them through the address given on their website, not any address connecting them to the debt collectors. You can then ask the solicitors to provide you with the information you requested in the beginning.0 -
DLC sent the solicitors letter out - they pay Aplins a retainer fee for this 'service'.0

Thanks both of you for that. I'm back in work tomorrow so I'll send a copy out then (saved it on my PC at work so not been able to do anything!)******** Never be a spectator of unfairness or stupidity *******"Always be calm and polite, and have the materials to make a bomb"0

Nothing from anyone for an age, then this morning I get, from D L & C,
PLEASE RING 0870 7469041 AS A MATTER OF URGENCY AND QUOTE THIS NUMBER: xxxxxxxxxx
I'm soooooooooooooo tempted to call and have a row, but I should just send in copies of what I've already sent, shouldn't I? Recorded delivery this time too!). Should I add anything?******** Never be a spectator of unfairness or stupidity *******"Always be calm and polite, and have the materials to make a bomb"0 -

I have a debt to DLC referring to a car finance I unfortunately defaulted on. When they originally sent the letter, unaware of this site, I called them to set up to pay it off as I know it's my debt. They would only allow me to set up payments for £91.92, and even tho this meant I have been struggling for the last yr I had to do it, was scared by the poss of solicitor's letters, court action etc.
Anyway I have just received a letter from them saying I must contact them as a matter of urgency, as even tho I have made regular payments for more than a yr, they must insist I increase my payments. I simply cannot afford this, and will communicate by letter from now on as can't afford to be bullied into paying more.
My question, is can they legally force me to pay more if I have kept up my agreement with them? Where do I stand on a legal front?
Any help much appreciated!!!!!!!0 -
Princess - they could take court action but that wouldn't necessarily get them anywhere, except for incurring more costs.
So this is just an exercise in harassment. When this happens to a client I send the DCA a polite leter saying that I have reviewed the client's circumstances and I regret that no improved offer can be made at the present time. I justify this with a financial statement (usually called SoA on this board).
You could do something similar. Or if £91.92 is really not affordable, do a review and reduce it!
You attached your post to a thread that was nearly two years old. I didn't notice at first, until I saw that Mr Roll had posted in it! In future it's probably best to start your own thread.
Best wishes.0
