Do I have any come back? Poor delivery service, Gardiner Haskins, Bristol

While delivering my new Miele washing machine they ripped up my brand new vinyl floor fitted by Cabot Carpets, Bristol (who are fab by the way).
They said it was up to me to protect the floor, but I thought it would be fine as I moved the old one in and out a few times with no problems. I did not expect them to be twisting, turning and dragging it around on the floor and really not taking any care at all, I thought they were going to be professionals. It looked like it was in a quilted bag so I thought it was going to be ok but turns out it was only the top and sides of the machine that were wrapped in the quilt, (what happenbed to the box)? Can I take it to the small claims? It is so dissappointing to suffer this can't be bothered attitude by a local independent company I now wish badly that I had gone to John Lewis. :(

    Did the delivery people ask you to put something down on the floor for protection? Did they tell you what had happened or did you discover it yourself?
  • No they did not ask me to protect the floor but the manager of the shop has just rung and said the delivery people did ask me to put something down on the floor which is a complete lie and makes me even more upset with this company. He said it is hard for him to know who to believe!

    He still said they is nothing they could do, they deliver 60 items a day and only have problems with about 4 a year so it is just my bad luck. He said he would be upset too if it had happened to him but he said if he compensated me then where would it stop people might be claiming for whole rooms to be wallpapered etc.

    Well I found this very unhelpful and surely keeping four customers happy a year would not cost them too much.

    This is complete hogwash. They damaged your property and you are entitled to have it fixed / replaced.

    I'd get an estimate for a repair, send a letter before action with the quote included (send it recorded so you have proof of receipt) giving them 14 days to comply and then take them to small claims court.

    Show them that you are serious.

    Surely the retailer/delivery people are insured, it's not as if it'll be coming out of his own pocket. As above, get 3 estimates for the repair/replacement of the flooring and send an LBA.
