doing a chargeback for paypal payment

i bought a phone off ebay, paid via paypal using my tesco credit card, seller never sent item and refuses to refund.
ive filed a dispute with paypal but its been nearly a month and they havent dont anything, im wondering if i can do a chargeback through my cc company, and if so how is it it exactly done?
or should i wait for paypal?

    I'd send a follow-up email to paypal first stated the exact date you contacted them and re-stating the purchase date and details.

    They are a bit duff, whenever i've asked them a question I always find it takes 2-3 trys before getting an answer to the question actually asked.

    You should also be aware that if you claim a non-delivery via your credit card, they seek return of funds from the company they paid, in this case paypal. If paypal have paid out they may then contact you and demand reimbursement, as they have sent out payment in good faith. (having been in a similar situation I've had a demand like this from Western Union - along with the threat of debt-collectors, thanks btw WU, for a claimback of $20).

    Email, keep a good date record of what you did when and any documentation.

    The seller should have a recognised proof of dispatch for a valuable item in case of just this kind of dispute. I sell the occasional mobile and always specify special delivery for precisely this reason and additional insurance so that the PO can pick up the bill if they've been pants.

    In the past I've found paypal act very quickly when a claim is filed. Did you submit the claim through the correct channels as if so full details of what is happening should show in your resolution centre in paypal.

    Having said that, you do still have the opportunity to claim back against your credit card. Most CC providers try to deny responsibility but don't be fobbed off, persevere with them.

  • the seller gave me a red del number (in the auction he clearly stated it would be sent via special) but the tracking number is a fake and doesnt work on the rm website.
    ive followed up paypal 2 times already, thats why im thinking of talking to the CC company now to get my money back.
    any ideas what sort of excuses they'll come up with to deny responsiblity and how i can counter them?

    on the paypal issue, yes i went throught the correct channel but its been at the 'Reviewing Seller's Response' stage for 3 weeks!

    I think its just paypal at the moment,I'm having the same problem with them,the complaint has been left at the same stage for weeks,before they used to act quickly,I think they must be on a go slow!

    Could try calling Paypal in dublin first.

    Paypal 0870 7307191 +353 14369001 UK accounts dealt with by Dublin office.

    1899 is 0.5p/min.
  • thanks im gonna give them a call tommorow, if they dont give me a straight answer ill phone my cc company.

    salsup you better email and push them because from what i know if the money is not in the sellers account, then they'll just keep you on the reviewing stage forever, its only if the moneys in the sellers account do they take it out and give it back to you quicker

  • Well I phoned paypal and the lady looked at my account and said that it could take a maximum of 30 days after the complaint is filed to get a result, apparently they keep on giving the seller plenty of days to respond but he hasnt (maybe because he's guilty, doh!), but I don't trust paypal, so i also phoned my CC company and within 30 seconds I was told they'd send me a chargeback form
    So an attack on two fronts should hopefully ensure I get refunded and get paypal working a bit harder.
