New car problems

I bought a brand new car under a pcp agreement in March. It had to be returned to the garage within the first two weeks as it stuck in reverse and then would not go into gear. The AA man got in gear eventually and it worked from then on. The garage where I got it said they couldn't find what caused it and that it was fine.
Yesterday I was driving along and went to change gear, it came out of one gear but would not go into another. The AA man got it working by putting it in gear prior to starting to the engine and it now works again, although is back at the garage.
What are my rights? This is an intermittent fault that is extremely dangerous yet cannot be replicated when back in the garage. It is still under 6 months old. Can I just return it? How do I stand with my finance agreement?

  • Your first point of call is the garage, but it seems they are doing their bes, in offering a repair. As this is a recurrence of an old problem, I would be a little more insistant that the offending part is replaced under warranty.

    have you taken the car back to the original garage? If so, point this out to them.
  • Surely you can ask the AA to give you a report of the problem to back you up. The car is still under warranty I would assume so they have a duty to repair the vehicle.

    I see you have taken out a PCP, therefore I think your purchase is covered under section 75 of the CCA.

    If the garage are not playing ball the credit company are equally and jointly liable so you are entitled to pursue them to resolve this matter.
