Urgent help - brighton bankruptcy a big mistake? Need a bank account!

I am absolutely cacking it having read some of the threads on here. I have to file bankruptcy at Brighton as it is my local court. After 2 years of dying under £80k's worth of debt I am finally manning up and going through with filing on friday but here is the problem.

I am making a fresh start and going back to uni to do teacher training in September and need an account in my name to put bursary money in - and of course have picked the only account in the country that doesn't allow you to have one!

I wanted to open a cashminder and was planning to do so on Monday after BR hearing Friday (27th) - will the OR still freeze it as I won't have been handed to them yet? I know they can't touch the money as student loans are not assets but can they stop me having an account? Am just in floods of tears now as uni and student loans are harrassing me for bank details and having paid for BR there is no spare cash to support me if this gets held up.

Anyone know what the deal is? Should I cancel at Brighton and try to go elsewhere?

    I opened a cashmonder account ready for BR date. I only used it for living costs and had my money paid in there. The OR didn't touch it, and as soon as I had my court papers, i hopped straight over to the bank to tell them. They have a BR section that deals with it, and as long as there isnt loads of dosh in there, and you can explain what the account is for, there shouldn't be a problem. I did however, draw out a weeks spends just in case, but I didnt need to.

    in brighton they do close the accounts but you can walk out of court and straight into the co op to open an account

    Thanks curly - so when you go see your OR after I guess you have to mention it but he won't freeze it as it was after BR?

    Hi crackle, No need to tell the OR if coop cashminder is opened after Bankruptcy Order date.

    they wont touch it was it was opened after BR

    dont worry if you go to the co op and they have to refer it - its standard - took me a week to get my first account, then after a year i've just opened another one adn that got refered as well

    sorry to disagree curly....brighton DO usually ask for co-op accounts to be closed open before or after bankruptcy

    nothing to stop you however opening another co-op account once the OR's interview is over & done with as you've said

  • Oh my god that's it I am totally screwed then - I don't get it how are they allowed to stop you when no other court does that? I can't wait til I see OR it will be months and need an account straight away or loan for uni won't get paid in! Will they ever make special circumstances?

  • If you can open an account after OR interview you'll be ok. I opened one, 10 mins of form filling in the branch, and it was open 4 days later,and if you ask, they'll give you acc. no. and sort code on the day so you can set your stuff up ready! Don't worry, co op were great with us and do everything they can to help, good luck from us both!
