Hi,
I defaulted on a Barclaycard a few years ago.
I think my last payment was in February 2003 and I moved around a bit and never got in touch with them as I couldn't afford to pay the debt which was for a few thousand pounds.
A few weeks ago, I got a letter from Mackenzie Hall asking me to contact them. I ignored this and today I got a nasty letter from them demanding twice the amount I originally owed.
They are acting on behalf of Cabot for the Barclaycard debt.
I am sure that this must be statute barred, but I have no idea if a CCJ may have been issued. I did the free credit expert trial and there is nothing outstanding and no searches showing that I wasn't aware of.
What letter should I send first? Do I want the statute barred, the prove it letter or the credit agreement one?
I would really appreciate any help. I've been shaking like a leaf since I got in tonight and I'm really worried.
I've no idea what the 'further action' promised in the delightful letter might be.
I got in a real mess a few years ago, have sorted myself out since, but do feel awful about this. There's no way that Mackenzie Hall are getting a penny out of me (at least I hope that's the case anyway). I owe the money to Barclaycard, not to them and I don't see why they should profit from this.

Hi Madcatlady,
As your now aware, Muck Hall as I like to call them are rude, obnoxious, aggressive bullies who specialise in pursuing debts that are close to or more often than not statute barred. Thankfully, you think the debt may be statute barred and didn't just call them to sort this out. You should send the prove it letter first, as if they can't prove you owe the debt, then they can't go any further. If they can prove you owe the debt, the statute barred letter is probably best to be sent next. HOWEVER!!!! don't sign any of the letters that you send. Print your name as these lovely people have been known to copy signatures to try to prove people owe the money. As I said, lovely people! Not. If they start phoning you tell them you only wish to be contacted by letter and send the harassment letter that's on the forum. If you can't find any of the letters just give us a shout on this thread.

Thank you so much for your reply. I really appreciate it. Do you know what might they be likely to send in reply to the prove it letter? I feel wrong sending that as I know full well that the debt is mine, but the SB one doesn't seem right as they haven't given me any dates.0 -

Muck Hall started to contact me about 2 debts that I thought may have been statute barred around October/November of last year. I binned the letters initially, but then they started to contact me via text to my mobile. Around March/April of this year, they managed to get my home telephone number (we're ex directory, so work that one out!) and started leaving voice mails. In May I came onto the forum and then sent the prove it letters for the 2 debts. To date I have not received a reply. After sending the letters I got a phone call at work (no idea how they got those details either) from a Muck Hall rep. I didn't even let them speak and told the lady I only wished to be contacted in writing, to which she replied ok and put down the phone. I then sent the telephone harrassment letter and have to date heard nothing, so hopefully you'll be the same.

Who do I put as the company name in that letter? Is it Cabot or Barclaycard or Mackenzie Hall?0 -
I would address it to Mackenzie Hall and then adapt it as required. Change the We for I etc.

Who exactly are Cabot? Why do they need Mackenzie Hall to do their dirty work for them? I'm really confused!0

They're both debt collection agencies (of the worst sort). It sounds like Cabot bought the debt and are using MH to chase it.0
