DSR's broken on refund policy

Online seller,

Item purchased, un-delivered and returned to seller. Seller believes that Seller is fair to charge postal charges both ways on item, and refuses to give me a refund for item postage.

Partial refund has been given.

I have contacted Consumer Direct about this, and they have said i should go with in order -

1 - Refund from Seller
2 - Payment Dispute
3 - Small Claims Court


At the minute, were about to move to Step 2, as seller is refusing to comply with the DSR's. I dont see anyway at the minute to enforce it without moving to Step 3.

Though, i will update when i action Step 2 when i get to it and go along as we progress.

    You're entitled to the outward postage back, not so sure about the return - depends on their T&Cs.
    Thinking critically since 1996....

    I assume this wasnt an ebay transaction? Or any software, travel/entertainment arrangements, perishable items or items of a sanitary nature?

    Ive had a reply to my last email sent from the MD of the company.

    Its a bit of a weird email, it started with the heading 'Without Prejudice' so you know whats coming, then it goes on abit.

    I think step 1 is complete, now to raise step 2.

    What company? What product? Are they a UK based company? What exactly was wrong with it?

    Well there wasnt one :P But i'm assuming (we all know how that goes....right?) the OP wants reassurance they're doing the right thing.

    Which all depends first of all, on whether its covered by the DSR's or not. Cant really impose UK law on a chinese company =/
