UKPC Parking Notice for Disabled Bay

Hi Guys
I am trying to get a bit of advice on a situation my sister has found herself in please:
Basically, she went to a play centre today with her kids and parked in their free car park. The car park is huge and there were many spaces free. As she was pulling around the corner a car came out of the space infront of her so she tucked in behind him and went into the space. There was a white line on one side of the space and a yellow hatched area on the other side. Her and the kids had a little look around but there was no obvious signage saying she couldnt park there so she went into the play centre.
On her return from the play centre she had a Penalty Notice Charge from UKPC stating that she owed them £70 for parking in a disabled spot (but they would generously allow her to pay £40 if she paid within 7 days!). She again looked around the area but could not see any signage to indicate it was a disabled spot. Funnily enough the car in front also had a Parking Notice Charge so that gives you an idea of how bad the signage was. Well she pulled out the space and it was only when she was leaving that she then saw a disabled symbol on the floor. She hadnt initially seen it because she pulled into the space as soon as the other car pulled out.
So am i right in thinking:
1. No contract as poor signage so no offer, and no consideration as free carpark anyway.
2. No loss/damage suffered because it was a free carpark.
???
Please help! Has anyone come across this company before please?
Many thanks!!!!

Yes well know on here. Your sister does not owe them a penny. The Blue-Badge scheme does not apply to private car-parks. The only legitimate amount they can ask for is the actual material loss suffered by the landowner. As this was a free car park then no material loss has been suffered.
All letters from them should be ignored, and no contact should be made with them. Please read all the other threads on here that deal with private parking tickets. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
Yes very generous discount offer of UKPC as usual.
I echo the response of trisontana, do not contact them and ignore everything they send you.0 -
Excellent thank you so much! Is there any legislation that says the blue badge scheme does not apply to private carparks please?
Thanks again!0 -

But don't appeal or write to UKPC at all, your sister must resist the urge to put her case to them - she must do absolutely nothing.
The advice to ignore is completely safe. She can ignore the debt collector letters they will send her - it's perfectly safe as it won't go to Court and has no effect on credit rating at all.
Please show your sister this thread and sit & laugh at these revealing links:

Examples of the debt collector letters to be ignored (then they just stop):

UKPC letter scans are shown on there - but I suspect they may change their debt collectors soon as Roxburghe/Graham White letters are so well known they seem to be losing their touch in scamming people into paying. Some other PPCs have started using different debt collectors this Summer so don't be surprised if the letter heading is different but the empty threats will be just the same!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My sister has already sent a brief appeal email to them though!0

I believe that UKPC have never ever issued a claim.
If they did in this instance it would not only be 'a miracle' it would be doomed to certain failure.
Follow the advice above.
Inform your sister that she can cease worrying.0 -
Thanks so much guys! Really appreciate it! x0

Hi,
I was 'presented' with a Parking Notice Charge...for 'parking' my vehicle in a disabled bay outside Curry's in New Mersey Retail Park (recently) so I could take my disabled daughter into the store for her to view and decide upon a purchase. (so far so good)
To my mind...(considered sane) the accurate and visible display of her current and lawful blue badge was sufficient, therefore, 'ONLY' the badge was displayed NOT the timer clock (as would be used when parking on yellow markings etc on the roadside.)
YET....When we emerged from the store we were gifted a PARKING NOTICE CHARGE from UKCPS Ltd - Our Crime (vehemently denied) was to have parked in a disabled bay with NO Badge displayed!?!
I rang the Police who were extremely understanding....But unable to help as they have no involvement unless it can be proven that this 'FIRM' UKCPS Ltd are acting unlawfully... hmmm
I am stressed by this and has taken my attention from more important and vital issues in my life.
What on Earth is going on with 'stuff' that is allowed in our Country for the sake of GET RICH QUICK SCHEMES?
I will not relent...This type of money making schemes should be outlawed.
Many vulnerable Law Abiding People would panic and Pay - this CANNOT be right0 -
And this is the parking company which Mobilise (a disabled driver's charity) have teemed up with to "further the cause of the disabled driver" and who call themselves "an ethical company". (are you reading this Mobilise?)
You must realise that the blue-badge scheme does not apply to private car-parks and UKCPS are clearly in breach of the DDA for discriminating against your daughter for breaking one of their silly rules.
You don't owe the parking company a penny, do not contact them and ignore any correspondence from them. Mobilise should be ashamed of themselves for linking up with these cowboys. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
