I don't know if this will work but if I was in your position I would argue that the contractual terms holding you to a years membership is unfair under the terms of the Unfair Terms in Consumer Contracts Regulations 1999.
Those Regulations are intended to catch the sort of situation where the consumer has no real alternative but to contract on standard terms.0 -
just another thing tho think of with Fitness First is they take details of your credit card or debit card at the time of filling in the application form. I was told that this was because if people cancel their membership and DD they put it on your card. Do you remember them taking the details when you signed up for membership ?. As you are in a contract they are well within their rights to expect that you pay so I think the best route is via your doctor - I hope you manage to get it sorted.

I assume this is a chain gym rather than an independant?
But, two things worth checking are whether you can get out of the contract if...YOu are moving out of the gyms area (and pick somewhere where there is not one of their chains of gyms) or 2. You are pregnant.
Both work for my gym (with moving I have to be beyond 15 miles of one of my chain then I can get a refund), but all of them are different. So what I would do is phone a different one from the same chain and say you are interested in joining etc etc...But are worried that you may be moving out of the area in the next x months...And ask them what would happen if this were to occur, would you be able to break the contract.
Then, try another from the chain and ask what would happen if you were pregnant etc
See what I mean, there will be a way out of the contract, you just have to find it. Then go back to your gym and tell them that x, y or z has happened and you need to break it.
I would go careful with the doctor route as whatever they write for your reason (thats if they will do it as it is not ethical practice for a doctor to lie) will have to appear on your medical records, which may not be great for the future.
I would try every other route first to find the loophole, then if nothing else appears.0 -
i wanted to join fitness first the other week, i was a member there before so i knew about how they try to get u to commit for 12 months.
its a bit off really that they want you to commit for that long, because surely its down to them to make going to the gym beneficial and rewarding so you keep going, not by locking you into a 12 month contract.
The worse sting is that they charge you loads if you dont want to commit for as long
£44 pm with 3 month contract
£33 pm with 12 month contract
and the membership consultant didnt even tell me that the prices he was quoting were for the 12months, if i had not been a member there before i wouldnt of known.
so if your thinking of joining make sure you check what your signing, i didnt join as he didnt offer me any deal or discount
but if anyone knows or sees any deals about for fitness first, make sure you post them0 -
Hmm, I think a lot of places will get you to sign up and not mention the 12 month period, I know it's easy to say 'You should always read the contract' but how many people do? You don't see it or have time to read it generally. And in perpsective, it's not a mortgage or loan contract. It's a gym contract!!
I wrote to my first gym about 8 month's into it, told them I was cancelling as I was moving away and that I had cancelled my bank's DD. Around a week later I got a letter saying they would hold me to the 12 month deal or take action etc. I heard nothing back and even now - two years later - they send me text messages now and then saying 'Re-join for a special rate...'!!
My second gym I cancelled around three month's after joining. Heard nothing back at all. Smooth. :beer:£2 Coin Savings = £0.230
