Are you entitled to claim ESA? DWP got the rules wrong.

    and how much is the limit? upto £62000 if you have a child under 1, so im sure you'll manage without it!

    And your friends circumstances must be different to yours because they are entitled wheras you are not, the system wouldnt give it to one person and not the other with the exact same circumstances - you sound like a great friend to them though!

    If you disagree with being turned down for Contributions based ESA and you believe you have paid enough, send in your p60's and get someone to look at the records.

    Ask for a full explanation as to why you don't qualify. If you still disagree ask for a Decision Maker to quote the relevant rule.

    I started this thread to try and make people aware that the DWP is incorrectly refusing to pay ESA to people who are entitled.

    If you have earnt (and paid NI) on more than about £11k in the past two years, it is very likely that you are entitled to ESA payments.

    If you don't know how to work it out, I would be happy to help.

    Your issue sounds like a simple balls up. It's not some systematic attempt to deny people what the law states they are entitled to.

    I agree real1314 -mistakes on someones NI records do happen- afterall there are 60 million of them. If it happens, when JCP issue the ESA disallowance form, I'm sure it would say- 'If you think your NI records are wrong contact us.....'

    The correct amounts of earnings on which NI have been paid/treated as paid to qualify for ESA(C) in 2010 are-
    07/08-£4350
    08/09-£4500

    Anyone who was self employed in both tax years, needed to have paid 50 Class 2 NIC in both years.
