    Some dodgy looking T&C's there. If you comply with the DSR's i.e inform that you are returning the goods within 7 working days of receiving them then they are obliged to refund their delivery costs.

    Also as the previous poster stated they do not have to be returned in their own, original, undamaged packaging as you would have the right to open the package, inspect the goods and reject them if you so wish. Yes you have a duty of care for the goods and should return them in good condition but that is what the DSR's are there to protect people for because you can't often tell the quality of a product by seeing it on the internet etc.

    Them stating they will not refund original postage costs is against customers statutory rights - although if they do sell mainly to other businesses (which seems likely) then this might explain why as i dont believe (i could be wrong, equaliser might have a better idea as he deals with B2B i think) companies have the same protection with regards to this as consumer.

  • Yea i realise all this but the thing is im 99% sure if i recieved the goods, i wouldnt need to return them.
    The fact is I am still waiting on goods that wer paid for(the money debited from my bank acc) on June 02 this year! Thats the annoying bit! Have recieved some great advice here, thanks! Will post any progress up for you all!
  • Bottom line paddyg001 is that they are in breach of contract and it is perfectly reasonable for you to demand your money back.

    If this is what you want write a letter to them stating that they are in breach of contract as they have not fulfilled the order within 30 days of the order and are in breach of the DSR's and that you want to cancel the order and have a full refund.

    If this comes to no avail you can contact your bank or building society as you used a Visa debit and there is the chargeback system which should help you in this case. Bear in mind though there is a 120 day limit for claims from the time you first realised the problem but it should help you in this case as there is a clear breach of contract. You could actually try this before even writing to the company, the choice is yours.

    After continous calls to Vanguard, they finally agreed to refund my account for the full amount! So im happy now i can make my purchase at a reputible store. Thanks to all for the advice!
