From your other thread it sounds like you are pretty far into the sickness absence policy already. If this is the case, I would not expect it to take months for dismissal. Check the policy, and if still unclear ask your rep at what stage you are at.

rep said he sent a letter to HR about my case and we'll have a meeting with them soon usually a week or 2. i allso asked him if i can have a copy of that letter cos i did not gave me one.

he did not specifically said at what stage but i will ask him.

I also asked him if i can have a second opinion. he said he will sort it out when he comes back from leave/holiday... and that would be few days before the meeting.
  • Why is it confusing?

My husband, now retired, was off work sick for over a year. He got paid all that time, first full pay and then half pay. He then returned to workwhen his health had improved, which was about thirteen months altogether. It is very a very common scenario.

To the OP, if your GP signs you off as unfit for work, and your Statutory Sick Pay has finished, you should apply for ESA (Employment Support Allowance). Once you are claiming it, a DWP Dr will also assess you and a decision maker will decide if you meet the crieria for the Benefit.

Being also paid from work will not necessarily affect this Benefit, it will depend whether you are on Contributions-based or Income-based ESA.

Hi, like you Between 06 and 08 I probably worked for no more than 6 months. In all of that time the Civil Service paid my full salary. Went back to work at the end of 08 and worked until March 09 when I went off sick again. From then until December 09 I received full pay until October then half pay. I was medically retired in Dec 09 on full pension.

Yes it is quite common that you can still be employed, receive full pay and receive ESA (Contribution based)

Have you looked on your council website to see how much the max local housing allowance is? If your rent is higher than the LHA you could apply for a discretionary housing payment, if you received this you would probably be expected to seek cheaper alternative accommodation.
Do you have any care needs, if so you may also be entitled to claim DLA.
I was in the same situation as you & received full pay for 6 months, half for 6 & then went onto IB. That was in December & my contract was terminated the following November, a temp was employed during this time.

i am now getting hb and ctb which i am grateful as i can now pay my rent (will top it up from the money i will be getting from esa) and will about to get esa hopefully in few weeks time.

i dont have any care needs now. i managed before with support from friends. my back has significantly improved. but given i am only in my late 20s, union said i should be assessed for disability as my means of living is greatly affected.

i am waiting for redeployment which isnt looking very good as my case will be for hearing for dismisssal and my union said it will take months.

what i am concern of now is esa will do assessment ( i understand) after few weeks to check if one is eligible for such benefit.
