Return and Repair of mobile phone...

i was after some advice...

35 days ago I ordered a Dell Streak mobile phone from o2. Been very happy with it, until Saturday night when it suddenly stopped charging. Now it's completely dead and useless. Just been to the o2 shop hoping it was the charger at fault and I could simply swap it over, but no joy... seems to be a phone issue.

Anyway, these things happen. The chap advised me to ring o2 and ask for a swap, but they probably won't do it as it's over 28 days (if it'd broke last Saturday I'd have got a replacement! Grr.). Not too bad except it's 14-28 days for a repair, which seems excessive for what is essentially a brand new phone that I'm paying £40 a month for. Do I have a leg to stand on if I ask for a replacement, or will they rigidly stick to 28 days? Also, do I have any rights regarding not paying the chunk of my contract which they have the phone for - essentially I'd have paid £40 for nothing if it is indeed 28 days fpor a repair...

    I'm in a similar boat, my phone which i got in Jan, just doesn't hold the charge now, so not only will my son be going to o2 tomorrow, i'll have to go to because of mine.

    I've had this problem with o2 before regarding sending off my phone for repair

    Unfortuantely it does take between 2-4 weeks for the repair but they do offer a "replacement" phone which you pay a refundable deposit for to cover you for that time. Although, the phone is usually an old one that doesn't have internet capabilities etc.

    It's worth asking for part of that months £40 back.. I wouldn't hold your breath though!

    i take it you have checked that bluetooth is turned off
