Mobility Car

I have higher rate DLA mobility and have a mobility car. The car still has 2 years left. My DLA is due to be renewed in November, my doctor feels it should be, because my condition has not improved. I’m worried that with all the cutbacks my DLA could be cancelled. I would appeal if that was the case. But will they take the car back immediately or wait for the appeal verdict. I do need the car for work. Thanks for your advice.

  • There are NO cutbacks to DLA as things stand,the only proposed change atm is the introduction of medicals
    from 2013 for all claimants.

    Although following a visit made today with one of my daughters' to the local Disability Information Centre (She went there for info on DLA for herself), and was told that yes, whilst it will be a while before the new 'medical' kicks in, they have been advised/warned by the DWP that criteria has been tightened up. Basically, a more thorough look at the claim is being made.

    What this means I don't know except that the guy there said that almost 85% of all new and review claims that the charity have got involved in submitting are being turned down.

    In the past the figure was 40% failed.

    He expects things to get tougher after October as well and even worse following the new medical regime.

    Suffice it to say my daughter has shelved that idea as she does not want or need the pressure of, a drawn out claim/appeal. She believes that if the evidence in the first place isn't good enough she can't see how it can be any better further on down the line.

    You can keep the car until the results of the appeal, a neighbour of mine, kept hers for 6 months whilst awaiting the appeal to reinstate her mobility and DLA.

    The opposite happened with a friend of mine - she had a mobility car for her son, who has numerous disabilities which result in high care and mobility needs. His DLA was stopped after an incorrect report from his school. Even though the parents immediately requested an appeal, the car had to be returned as soon as the money stopped.

    Initially, they were told it would be three months until the outcome, but that time has doubled and it will now be November before the appeal is sorted out. In the meantime, they have no car and the school are really awkward about him coming to school in his wheelchair - but there is no way he can walk two miles and public transport is unsuitable due to times of buses and also his disabilities (he has autism, among others, and finds buses very difficult, especially when they are busy).

    When her DLA stopped, and she was asked to return the car, she went direct to mobility themselves, and explained her predicament, mobility let her keep the car, because it is not in there interests to take a car back only a year into the contract.

    She had the car right up until the appeal. They have special rules for situations like this.
