Completed IVA - overpaid, return cheque received in maiden name, will I default??

Hi All,

I have just completed on my IVA – I have yet to receive the certificate of completion.

I contacted the IVA Company prior to completion to check if the IVA was definitely going to complete and if I needed to cancel the standing order. They were very vague in their response, they did not confirm whether it was coming to an end and said the SO would automatically be cancelled by the bank when necessary.

As I suspected the SO was not cancelled and I overpaid.

The company have sent me a cheque for the overpayment however it is in my maiden name. I have been married for 6 months but did not tell the company this.

The bank will not accept the cheque. Can I ask the IVA Company to re-issue the cheque in maiden name – will this result in me defaulting? Is there anyway around the issue?

    Yes of course, contact your IP's company and explain to them. They will probably ask for you to return the cheque and then they will issue you with a new cheque!

    I am surprised that the bank will not accept it, as long as you take along your marriage cert to show them. If it has only been 6 months (Congratz by the way :-) ), when I worked in a bank, I would have accepted it for that time frame

    I took my marriage certificate and several forms of Id, but they would not cash the cheque. I did consider possibly taking it cash converters? This is not something I have done before so am not sure how it works.

    Will the IVA company have grounds to default me as I witheld the fact I got married?

    You had completed your IVA, why should you be defaulted now? If you are having problems cashing the cheque in your maiden name just call your IP/case administrator and ask if it can be re-issued in your married name, it shouldn't be a problem once you show them your marriage certificate as proof (I re-issue cheques for that reason all the time ;) )

    Secondly and most importantly you need to check if your IVA payments were made by Standing Order or Direct Debit, the difference is subtle but important,

    Standing Order = You ask your bank to pay the IP/whoever

    Direct Debit = You authorise your bank to allow your IP/whoever to take payment from your account.

    A Standing Order can only be stopped by you, your IP has no control over it. You need to cancel it yourself!

    A Direct Debit can be cancelled by either party.

    Check before another payment goes out.
