mobile phone problems

My son has a problem with his mobile that his dad bought for him for Christmas, he would like to know where he stands now..

original phone was repaired (or tried to) 2 or 3 times, a known fault, o2 decided to replace phone and now this one is behaving in the same way.

Can he ask for his money back, and get a different phone?
or does he need to go through the palava of phone being sent back, problem arising again and sending it off again.

I've advised him that if he can get his money back or offered another phone of the same value, not to have a Sony erricson as there seems to be an issue with these particular ones.

Can anyone advise on what should be done now?
