My Father had a stroke in April and is now in a Nursing home,
My Mum still lives in their home which they own apart from an Equity release.
We now have POA for Mums finance in place along with joint tenants in common etc re the house they own.
My Father would inherit 50% of the home if my Mum dies before him , I would inherit the other 50%..
My Fathers stroke has left him incapable of making any decisions for himself .. I already have become his apointee re his pension etc regarding the payments to the nursing home.
If my Mum dies before my Dad I have to have something in place to ensure that his 50% is well managed and that it goes towards his fee,s for the Nursing home.
Can anyone give advice as to how I can get this sorted?
Thanks

There is a form of Power of Attorney called deputyship that you can apply to the Court of Protection for.
Unfortunately more long winded and expensive than normal Power og Attorney.0 -
Thanks Dzug1 ,would I be right in applying for this now or should I
wait ?
I know this sounds really awfull but having dealt with the legalities over the last few months re my Mums situation and Dad going into a home, I really must make sure everything is covered if this should ever happen.0 -
Sorry to hear about your Dad's stroke, and your associated problems.
You say your Dad is in a nursing home - has he been assessed for NHS Continuing Health Care? Maybe he's getting it? If so I'm glad, but if not please take a look at this thread as it might be helpful to you.
Best wishes to you and best of luck in looking after your parents, something I know from experience can be very difficult.0 -

Do it now - it takes months to get it.0 -
