Need some Advice please.

I apologise in advance for the long story but i just want to get all points across.

I bought a blackberry phone from a seller last saturday.I paid for it straight away and didnt recieve it till today even though I paid £5 postage. So when i turned it on to check it worked it seemed fine but about half an hour in it faded out to a blank white screen and just died on me even though the battery was fully charged.
So i took battery out gave a good clean and tried it again and it went on for another 10 minutes. and it hasnt come on since. Now i went on to the sellers feed back and i have seen she bought a phone with the exact problem 7 days ago and the auction for the phone clearly states not working properly and she seems to have sold it (on in the auction i bought in as the dates tally perfectly)knowing there was a problem.
Now i paid nearly £100 pounds for this used phone and i am really annoyed about this. I also emailed her on wednesday to find out where the item was and she never got back to me till last night. I have found a few other problems with the phone as she has given me the wrong size of usb cable so i cant even find a cure on the internet for this white screen and she has given me the completely wrong booklets for the phone as well. When i recieved the phone today i gave her feed back as appropriate as the phone seemed fine. I have sent her this email:

Hi there i have recieved the phone this morning and it is not working correctly. you have given me the wrong booklets for it and also the wrong size of usb cable and every so often the phone fades out to a blank white screen and there is an odd blue mark on the screen which is visible in the picture i am going to send. i just googled the white screen and it sounds like the white screen of death. i have not even had the phone 2 hours and i am having problems. here is some photographic evidence of the incorrect books and the said white screen. I know the auction said used but i need to be able to use it. i have all ready given you positive feedback as i know what a nightmare ebay can be. If you could respond with a solution i would be grateful.

Natalie

And i havent heard anything back. What Should i do? Am i covered by paypal as it stated no returns accepted but she sold me a broken phone and she already has her feedback.

Thanks again Natznjames

If the seller's listing made no reference to faults, no documents etc. etc. then raise a dispute with Paypal for Significantly Not As Described (SNAD). You must then send the phone back using Special Delivery, chances are you won't get this cost refunded.

Giving +tive feedback already won't affect your claim.

    >it stated no returns accepted<

That's BS and should be ignored by PayPal

I'd give her till Tuesday then open a dispute, believe me if they haven't replied by then, a dispute opening seems to spur on communication! You have 45 days to open one.

Don't fret, you'll get your money back ;)
  • Thanks very much.. It was supposed to be a birthday present to myself and it has just been a hassle
