necklace with no proof of purchase

I bought a £100 necklace from swarovski for my mum in law and its the wrong one.
for some reason I can't find the reciept anywhere!!!
I know the time and date I bought the necklace because I called the store 2 minutes before I walked in and purchased it
I've called the store and they won't give me a refund
is there any way around it, because I know the time and date i bought the item, the store wasnt exactly busy either

If it's a matter of you having bought the wrong necklace, then they don't have to refund you regardless of whether you can find the receipt or not, so check the reasons that you were refused a refund. If they stated that they would refund you if you had proof of purchase then a bank statement should do the job. Failing that, do they have the necklace that your Mum wants so you could exchange one for the other?0

You might be entitled to a refund under the terms of the contract, but you would need proof of purchase. It is not correct to say that you are not entitled to a refund just because you've changed your mind. The SOGA does not provide for this, but often the terms of the contract do. There is, however, no statutory obligation on a retailer to refund because you change your mind.0 -

What contract ? If you just walked in off the street your "contract" IS covered by SoGA - unless of course you brought your own with you and the shop and it's Legal Advisors were happy with it, and signed up to that !0 -

I think what she was saying that this is not a protection under SOGA but if the employer gave a term of contract such as no quibble return in 7 days etc.

The contract between the seller and buyer. It's perfectly normal for there to be additional terms over and above what is covered by the SOGA. Lots of big stores have a refund policy over and above that covered in the SOGA. That policy forms part of the contract between the buyer and seller. I'm not really sure what you're getting at talking about legal advisors and bringing your own contract. I think you've got a bit confused.0 -

Problem is, a lot of the policies i've seen that give additional refund options over and above statutory ones, generally have it built into their T&C's that they reserve the right to refuse/its at their discretion.
So not so much an entitlement as relying on their goodwill and hoping the manager is in a good mood!
However its worth noting that although you can use bank/cc statements etc as POP when returning a item under your statutory rights, i believe if you are returning under the stores policy, they can ask a receipt be produced (although i'm sure someone will correct me if i'm wrong!).You keep using that word.
