HSBC - advice needed please!

Hi, I've posted this in the bank charges bit as well sorry if I'm in the wrong place.

I'm currently negotiating with the hsbc (with the help of cccs), trying to sort out a payment plan on my loan & overdraft with them, this is probably going to take another few weeks at least.
Meanwhile, I've filled out the spreadsheet with all their charges & interest since I opened the account (5 years) and my total's around £1800.

I also filled out a spreadsheet for my old mbna card - I don't use this card anymore - I've written to them and asked for £282, they said 'no, we're in the right, but you can have £90 if you want'. I'm now at the stage where I've issued my court claim for the full whack and am waiting to see what they do next.

My dilemma now is do I wait til my debt plan is all sorted and in place then claim from the hsbc? Will I be too late to claim by then? Are they still likely to pay me back if I've got a minimum payment thing going on?

They've charged me over £300 just in the last month, even tho I've been trying to sort it all out and the total of nearly 2k is a lot of money - it would help clear the overdraft! I don't want to miss out if there's a chance I could get it back.

Can anyone help me out? Does anyone have a similar situation? I'm a bit lost!

    I wouldn't hold your breath for HSBC to accept your plan. I am almost 4 months in and they haven't and according to the guy I spoke to the other day, will not accept. They say that I have signed an agreement, to pay x per month and the only way they can accept y is by me signing a new one. This is clearly not allowed with CCCS as it amounts to new borrowing. My advice is to move your salary (if it is still there) away from HSBC and get on with claiming the money from them.

  • Same here. I've been on my plan since March this year and HSBC won't accept it unless as part as a managed loan, which I am not doing!

    Agree entirely with joolz43 with regards to get your salary paid in somewhere else.

    Good news though, yesterday I got a full and final offer from HSBC for my £1000 bank charges. It felt so good after their complete lack of support. Make sure you get them to issue a cheque only though or they might just want to take it off your debt and as you're on CCCS it'd better to get a cheque paid into your new account then pay CCCS it so it's spread over your debts, not just HSBC.

    And also, to answer one of your orginal questions, your DMP won't affect you getting your money back. I've done it and so have many others. It's unlawful and you are owed it!

    Best of luck with it all. I've now had a letter from HSBC saying they're going to default my account/get rid of payment protection etc which is what I've been waiting for for ages. Little do they know my pay is going up significantly as of next month and if they'd just accepted my plan they would have been able to have higher payments than my original loan, but now a debt collector will get it instead!

    Thanks for that, they have tried to get me further into debt - and have even offered me a shiny new 4k credit card. Isn't that against the banking code or something?

    Also, they refuse to stop phoning me 4 times a day with the same questions, did you get that too?

    Can't wait to be free of them - I'm sure they never mentioned all this when they gave me my griffin savers dictionary & 'holdall' ;)

    Completely agree with the posters above - move your wages to another account & claim your charges back. I got my bloke's charges back from Halifax last week, brilliant stuff, and it'll shave at least a year off his CCCS plan term. Now to tackle the rest! :T

    Thanks, I might hold you to that, It's driving me a bit bats at the mo :o

    I've sorted moving my wages and other DDs, I opened an Alliance & Leicester current acc. a couple of weeks ago so I should be ok, in theory they can only have what I give them.
    Got to wait til 13th Oct (friday the 13th - for me it'll be a good thing!) to speak to CCCS properly, I'm hoping they're gonna help me by sorting a DMP.

    That's why I'm worried about writing to HSBC for charges really - I'm scared they'll be hacked off at me for demanding my 2k back and will be able to scupper my plans to get sorted - could they do that?

    Thanks to you all for listening to me rattle on, I don't know what I'd do without you - the cat's now tired of hearing about spreadsheets and the wonder of ebay...

    It might (or might not surprise you to know) that in my experience HSBC take a bit longer to recognise such links. After all, the debt management dept said they didn't have my home phone number, when the company have rung me many times there. I don't think communication within the company is as good as you might expect!

    Good for you - it sounds like you're doing brilliantly. Believe me, the scariest part of the CCCS was making the appointment! The lady we spoke to on the phone honestly couldn't have been nicer, kinder or more helpful - she was absolutely lovely, and it was like a cloud had lifted! :D

    Nope, absolutely not. They can yell, and stamp their feet, but at the end of the day no court would make you pay more than you can afford, and that's where CCCS come in - they'll work out exactly what you can afford to pay across all your debts, and they do understand that you need to *live* while you're on a repayment plan, and that if you over-stretch yourself you might slip off the plan, so they're very sympathetic, and completely non-judgmental.

    You too, eh? Think my family's ears healed over months ago. They never seem to mind the treats we can afford with the savings, though...;)

    I had a letter from HSBC yesterday waiving the £5 fee for the request of bank statements. First slight piece of generocity from them, and they know why I am requesting them! Can't wait to get going on my claim for charges!

  • I have had problems since april HSBC won't accept payment in any form, wheres the sense in that???

    since first speaking with cccs and being told to make token payments until dmp started in june, HSBC have:

    refused ALL payments offered
    called me 3 times a week to be abusive
    refused to accept CCCS paperwork
    been completely patronising, and rude

    They still contact me and tell me to pay the charges on the account, they are uncooperative and lazy, rude and rather stooopid

    On several occasions I have even asked them to call during the day when I am at home because my husband works on early shifts and has to be in bed by 8 and they refuse to do this. Resulting in a peed off hubby and stress at bedtime.

    I HATE HSBC, with a vengance

    Ring them and tell them you're changing your phone number and give them a random number(but write it down so you can quote it back to them if they ask you)
