I am having problems with gettin 252.00 back from we fight any claim. I cancelled within the first 14 days and spoke to mr skinner on the 20the july who advised it would be 30 days. Today the money is still not in my account. I called again spoke to Mr Skinner again who said it will be 30 days from today as the refund was not signed off. Asked why he did not do it on the 20the when first spoke he couldnt answer that. I have wrote letter after letter to this company but never recieved anything back. Is there anywhere else i can complaint about this and get something done as this has incurred me with 155.00 bank charges now.

    How did you pay the company? If by card, perhaps the card issuer can help you.

    Otherwise, I would think about issuing a letter before legal action, and then possibly a summons.

    However, even getting judgement may not mean you get the money back. Make sure they actually have any assets before you waste any more money over this matter.

    Oh, and mitigate any losses (such as ongoing bank charges). Even if you win judgement and get paid the original debt, a failure to mitigate your losses wont hold favourably with the judge in any request for anything extra.

    The FOS are there to to settle individual complaints between consumers and businesses providing financial services. Whilst this covers many aspects such as banks, insurance, credit cards, mortgages, etc I don't believe it extends to reclaim agents as they don't offer any "financial service".

    The FOS may be able to help with whatever bank or credit card claim the OP originally approached the agent about, but the formal complaint procedure of the business converned must first be followed.

    The FOS are there as an independent adjudicator to deal with complaints with an FSA authorised company when you have reached deadlock.

    Claims companies are not regulated by the FSA and the FOS has no remit over them.

    edit: oops, just noticed Premier said the same thing earlier.

    I take it you mean FOS helping in the claim back of whatever the OP was hoping to claim back with help of the claims company and not help in getting the OP's money back from the claims company?
