Help please! My first problematic seller.

I won a buy it now auction with shipping terms of 1-2 working days.

The item took 19 days to arrive and during that time I emailed the seller 2 or 3 times asking where the item was.

They said that I should read the 'read me' bit in their ebay which states that they are often too busy to post items and can sometimes only post once a week.

I have never had to read a 'read me' bit in ebay before and always just go on the auction details.

Anyway the items arrived 19 days later. I left a negative for them as this was unacceptable in my eyes.

They left a negative for me straight away stating they had told me they were on holiday (not true) and immediately after I got a mail from ebay saying they had opened a dispute for the item as it is unpaid!!!!!! :eek:

From their feedback, I can see they have done this before.

I paid via paypal and so have proof I paid.

Can anybody tell me:-

1. What is the outcome for this generally (when I have proof I paid)

2. How can I reply to their comments on my feedback, I can't find anywhere to do this but I know it can be done because they replied to my feedback.

I am so mad about this. They are a real chancer!!!!!!!!

I would really appreciate some help from anybody here.

  • 1. Check they haven't refunded you. If they haven't, they don't have a leg to stand on with the unpaid item dispute. Put the paypal transaction number into the dispute console.

    2. Never had to do this but someone will probably be along to explain it. Calm down before you post your follow-up - a calm, factual reply will make them look worse than a rant!

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    I left my explanation in the dispute form and sent it back explaining that I had paid and that I have a receipt.

    The seller responded ...

    'No thanks, don't need the reciept, in fact ebay don't even read these dispoutes, these disputes are
    between me and you and no one else...'

    They are obviously playing some kind of game and retaliating to anybody who leaves them a neg!

    How can they get away with this!!!!!

    to reply to feedback, go to your ebay, click on feedback on the left side, then click on go to feedback forum, you can then click on reply to feedback ;) don't write anything that would make you look bad etc though, just state the facts :) good luck

  • I've never been on the receiving end of a non payment dispute.

    You've responded to the dispute which was the right thing to do. He's correct, I believe - ebay don't monitor the discussions within the dispute. Not sure if they get briefly reviewed when the dispute is closed?

    I guess you could ask him... as he's so keen on playing games... what he thinks he will achieve with the dispute, when both of you know you paid.

    At some point you get the opportunity to give your paypal transaciton number which in theory should be conclusive in your favour. As I say, I'm not sure when you shoudl do that.

    Thanks for your replies.

    I must admit to being completely baffled by this.

    The seller is blatantely telling lies and they obviously know the system enough to get away with it.

    Can I name and shame them on here so that other buyers can avoid them, or is that against the rules?

  • i have had a non-payment dispute files gainst me before after i'd neg f/b them. the seller had emailed me to say she had recieved payment too.:mad:
    nothing has happened apart from she left me neg f/b. as she has a lot of neg f/b it looked worse for her. i have since had loads of pos f/b and not had any more probs.
    it is the most annoying thing, but what can we do????

  • Clearly this TSFE person is trying to get revenge by trying to get you an unpaid strike on your account.

    It's nothing more than jealousy (because you neg'd them) and petty minded revenge. Stick to your guns. As FF says, at some point you get to put in the paypal transaction number, and the dispute will then be pointless.

    Do indeed post their username (or a link to the item), as i'll be happy to block potential troublemakers from my sales.
    It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

    Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.

    you've no need to worry! a few things can be done first of all

    1)report seller to ebay for threating email

    ebay always act on these reports and do investigate.

    2) as the buyer in the dispute console click you wish to complete sale!! seller now has no possible way to get a NPB strike against you, and they cant get fees refunded. (you've paid item and already and have it so no real losers)

    Sellers now had ebay rules turned on them! ;-)

    now ask for mutual feedback withdrawal for item if they any sense they'll agree. if not still options left to to try get you neg removed if it bothers you too much - ebay grey area though!! sometimes works.

    i had this from a seller.Ebay did listen and did sort it.seller got suspended for a bit and my feedback from them was removed by ebay.
    keep at it and send a copy of their email to the link above.It does work.
    Every day above ground is a good one ;)
