Short story- in May I was stationary in my car when suddenly another car drives alongside too close and damages my car- the car has been repaired and after lots of conversations with other driver who didnt want to go through insurance I got a quote which he then accused me of lying about saying I was conning him! He mentioned another garage so I kept asking him for their number but he "didnt have it" etc. About 10 days after the accident he decides he does want to go through insurance- my car gets fixed immediately. I then get told they are still waiting for him to admit liability. 2 months after the accident I get a letter saying he has an independent witness saying I drove into him!! This is a blatant lie and I am so f***ed off right n ow- I wont lose no claims as it's protected but do I have to tell insurers in the future that I was to blame for this accident? They've said they cant/wont do an investigation into proving the "witness" & other driver know each other, is it worth my while asking them if the report from garage that fixed my car would prove I was stationary??
Any info/advice gratefully received, am so annoyed about the principal that he will get away with causing damage and lying about it!!

Just called insurers for some clarification- apparently if I had a "witness" it would be ok but they have to take his word for it! They wont investigate if it even is an "independent" witness and there is some form of penalty for the insurers if they try to take him to court claiming he is lying?!
I recited everything to my insurer regarding the incident & all our conversations since then- basically he said there's nothing that can be done but he understands my frustration! The garage that repaired my car wont be able to tell how the damage was done and they cant just take my word for it cos he has a "witness".

I wouldn’t have thought your legal cover will help either, the only way you can do it is to gather (or pay someone else to gather) the evidence you need. Once you have it (ie you’ve done their job for them) I’d guess the insurance company will act, I’d have thought they all have fraud departments0
