Hi all,
Wonder if you could possibly help. I am in the process of reclaiming missold PPI on a credit Card for a friend through RBS.
They have sent a final letter saying they are not repaying after investigating all the reasons for mis-sell. They are saying it was a postal form and that all the info would have been explained and correct. We put it was during a meeting which my friend is positive it was.
I believe a lot of these applications were handed out over the counter or during a Review Appt. They are also saying that all the reasons e.g Person selling not qualified to do so, reasons for sell etc are legitimate.
What is my best form of defence in the FOS complaints Form. They are not getting away with it!

    Hi Shamrock, hope your well.

Have your friend requested for subject access request (SAR) by any chance?
Its possible that info on the sale of the loan maybe enclosed within the SAR, if this was taken out over the last 6 years.

If its not the final decision where they should enclose details of the FOS, then your friend could write back and request they consider and add any further information your friend may have.

Otherwise, yes complain to the FOS.
Your friend will have 6 months as from the final decision to complain to the FOS, so "maybe" there will be some useful information within the SAR, although there are no guarantees.

    Good luck.:)

RBS rejected mine as well but the FOS upheld it and it was dealt with much quicker by the FOS than loan PPI complaints. Took about 3 mths.

Do as Di says, request an SAR and once you are sure of the way in which it was sold, then send a complaint in to FOS. Good luck!

Yes, definately SAR them. If it comes about that they DID give advice to your friend then this would show what complete and utter liars they are and I doubt it would get to FOS anyway if you proved them wrong.
