Advise Please Re;Tree Problems Council Tenants

Hi , Can somebody please give some advise regarding the following;

We have been council tennants in a 3 bed house for 5yrs the problem we have is that our back garden has been invaded by a tree which has been allowed to run free from the property next door.

This property is privately owned and is rented out to another family who could not give two hoots about the tree! Our problem is that the roots of the tree have raised the patio slabs on our side of the boundary. Our garden is totally unusable because of the Overhanging tree which comes in at 3mts over our garden and also covers about the same onto our roof space and also blocks the guttering, but the patio resembles an "Mexican Wave" and is a health and safety issue.

We have had numerous debates/ rows/discussions with the council and have also contacted two councillors but we keep going round in cricles without anything being done. (Since we moved in)

Our argument is with the council, I/we rent our property from them, which includes the back garden, with a tree the size of what this is
do the council have any responsibility regarding cutting it back?
They are saying it is my/our responsibility to cut the tree back.

The council suggested that they would remove the patio and lay a couple of inches of shingle to improve the look of the garden,but would not do anything regarding the tree roots or with the cutting back of the branches. We told them that this was not acceptable.

The council have suggested we try and contact the landlord and sort it out with him.. We have also been told that the tree is from a bird dropping and wasn't planted at anytime.

I hope I have explained as clearly as possible and not ranted.

Any consructive advise would be gratefully welcolmed

    Is the tree under a tree preservation order?

    Are you in a conservation area?

    Is the next door property also owned by the council?

    Is the fence affected?

  • Why are you refusing to cut down the overhanging branches especially as they are blocking the guttering and risk causing damp?

    Bitterandtwisted,, The tree is very very big/tall, I'm sorry but I do not posses the required skills, This is exactlly what I'm trying to get thru to council , This tree is basically a threat to their property.

    The feeling I get is that they shan't act until it. does damage the property

    I was hoping that they had an obligation towards their tennants in the same way as we as tennants have an obligation to look after their property.

    Dont be ridiculous. You cant just go into a neighbours property and cut the tree down. It sounds like in this case the tree is owned by the council.

    If you are that sort of neighbour that just wades into someone elses garden to "undertake works" then Im glad I dont live next door to you! :D:D

    Have you mentioned this to the Environmental health helpline at your council ?Or are you just dealing with housing officers?

  • It's my understanding that LA tenants are obliged to maintain their gardens and grounds themselves. If the thing is too big and high for you to attempt cutting the boughs back then you really, REALLY need to contact the landlord of the property next door and have a discussion about how to tackle this. I have a feeling that your LA won't be interested until the roots start undermining the foundations.

    I would suggest in the meantime that you put your concerns in writing to the Housing Department and let them know what you have done to try and resolve this yourself. i.e. After you have had a discussion with the LL next door.

    The tree is in next doors garden which is privately owned. This need to sorted with the neighbour rather than going to the council whio are teh OPs landlord
