Help me get a bed out of my house!

I placed an order with Frances Hunt for a bed and mattress on 10 June and received the incorrect bed a few weeks later. I phoned them yesterday to cancel the order as I still haven't received the replacement after 10 weeks. They had already taken my money - actually a couple of days after I placed the order - cheeky! They've ignored all my e-mails for updates and dodged me when I phoned for an update. I want the money as soon as possible because I've spotted another bed I want.

My first question is about how quickly can I expect to get my money refunded. I assume they should do it straight away and I then wait a day or two for the bank to complete the transaction? Apparently I had to send an e-mail to the manager to confirm I wanted to cancel before anything would happen, which I did yesterday. I'm going to phone them again 24 hours after I sent the e-mail because they totally ignored 3 of my previous e-mails asking for an update to my order. They also dodged me when I phoned for an update - they told me they would phone the next day with an update but never did. So I'm worried that these punks are going to be elusive!

My second question is about the bed that they will need to take back. I left the bed down stairs and never unwrapped it. I have however used the mattress. They did tell me to use it in the mean time, while I waited forever for a replacement that has never arrived. As I've initiated cancelling my order, could there be any problems with me already having used the mattress? They told me to use it and it was a bundle with the bed. If I kept just the mattress it would cost a lot more for me to then by the bed separately. I was just wondering where I stand legally. As far as I'm concerned it is their problem.

My third question is how quickly can I expect them to remove the bed and mattress. It's taking up a lot of space in my house and, after 10 freakin' weeks, I would like the monolith to vanish from my lounge! Basically, is there a time frame, legally, in which I have to hold the goods for them to pick up before I can either give it away or put it outside to get soaked in the rain because it is no longer my responsibility to look after it?

If anyone has anything to say about this, that would be great!

    You bought the bed and mattress as a bundle, so send them both back as a bundle.

    If they are being difficult, then contact Trading Standards ASAP.

    If you have written proof that they said to use it then there should be no problems
