maternity allowance questions...

Hi all, i am hoping someone can help (i have printed out stuff from dwp website so i dont need links to that etc)

I was all sure on the criteria etc but just spoken to DWP now and they have confussed the hell out of me!

I am only 12 weeks preg so know i have time to sort all this out but i am trying to put a budget inplace now for the family to stick to

As i understand it if you have worked 26 of the 66 weeks before baby is due you qualify.

Now, my contract at work is ending soon it was only temp so i have 23 weeks ot of the 26 weeks needed...

Here is where i am confused, i had my son in dec 2008 and was on mat leave for 6 months. My GP signed me off work sick from May to December 2009 - Anyway, i got ssp for 26 weeks and then this stopped so i didnt get paid anything.

Work and i decided it was best if i finished in mid Dec 2009, so i did. I then got paid my holiday pay etc.

Now, due to when this baby is due etc some of these weeks overlap within my qualifying period for maternity allowance. So i can include them, but i wasnt actually getting paid as i was no longer entitled to ssp... but i did get my holidays paid..so could I count these weeks as working weeks as i was still employed, even though i only got paid my holiday pay? I got paid monthly so these holidays were paid in one months wage and were subject to tax and NI etc. The holiday poay was 27 days holiday (if that matters at all)

I have spoke to DWP one person said that it would be ok to include them, another that thr original woman spoke to said they woudlnt be included as i hadnt been paid, even tho i was emplyed!

Can anyone advise re this please?

Also, is MA means tested? I am a ft uni student does that effect it in any way?

    I wouldnt think you would be able to include them as they werent paid working weeks which is what MA is asking for. And you also need to provide proof in the form of payslips. So if the payslip for that period just shows holiday pay you wouldnt qualify.
