  • You need to be aware that some Ts know how to work the system and they can, and do, run rings around inexperienced LLs.
    - She's a 1st time tenant, having just split with her husband, so hopefully she won't run too many rings :S

    What evidence do you have that she has given notice? You say that she has moved out - did you witness this and has she handed the keys back to you?
    - I did witness her moving out, but do not have the keys or any written proof of her notice (despite her saying she sent it to me...with no PoP or Recorded delivery)

    If no, then this and the fact that she has not given you written notice and that her possessions remain in the property means that you need to be careful how you handle things.
    - I'm not planning to re-enter until she has returned the keys/given notice/i've got a court order

    Note that you can only charge the T a "reasonable" amount for dealing with dilapidations.

    You will need to show that you have tried to contact the T and/or the guarantor regarding possessions left behind.

    Did you scheme register the Ts deposit btw?
    - Yes it's with the DPS

    I was planning to see if my new letting agent would organise the repairs/works - they have a panel of tradesmen and will get 3 quotes for works needed, of which I can choose the nest and they will organise it.
    The T has given permission for agents to visit the property for viewings/marketing purposes, as she is hoping I will relet it before her notice period is up and let her off some of the rent... (FAT CHANCE the state she left it in!!!!)

    Obviously I believe she has left the property, and refused to give me her forwarding address... so presumably I should send the S8 to her parents (guarantors) address for her attention?

    I'm considering joining LL Law - although i have no income at the moment, so don't pay taxes ;), but £80 is a lot when I have a house to clean/repair/garden and relelt with no rental income!

    Double check but I believe that landlords must serve the notice to the tenant at the address of the rental contract - their non occupation is irrelevant, a landlord should keep proof that it has been served.
