Item bought from Ebay - box empty!

DS has just bought Xbox live points from an Ebay seller (with good feedback)- seller had 10 or 20 up for sale. The envelope arrived (undamaged) and I signed for it, DS opened the sealed case and - guess what? Empty!
He has messaged the seller last night, no reply as yet. I'm not sure this is going to go well - it cost £20 for nothing, but will anyone believe him?
Don't want to panic yet and have told him to open a dispute with Ebay if there is no reply from the seller.
Anyone ever dealt with anything like this before?

Im not sure if this is going to be the case with your item but when i bought a 12 month live card my seller sent me the code via email and an empty envelope which i signed for, he told me he was doing this to protect himself against item not received claims, i hope its the same for you as im pretty sure as you signed there is not much you can do. What was the sellers feedback like??:beer:0

Double check the listing closely - it might have been listed as an 'Xbox box' or something similar. If that is the case then I'm not sure if you'd be able to file for an item 'not as described' as, unfortunately, they had advertised a box and you bought a box.

When will people learn to never sell anything sealed.
I have often opened up a freshly sealed brand new shop bought item only to realise some kind of fudge up in the factory has occurred.
Seller really has to refund you and chase up the problem with wherever they bought it.0 -

Well, to update - there's no email with a code in it and no reply from the seller so DS has just opened a dispute through Ebay - we'll see what happens!0

You should try to contact ebay regarding this but I think there is no proof that box was empty so you might be in trouble, Thats why most of the time i would prefer to stay away from big purchase from ebay0

£20 is a lot to lose for some people!! i'd certainly be very put out!!!
am sorry for yr experience mrs money, thanks for yr post, it's a good reminder for awareness online and when signing for something received. this once happened to me with a) a non-ebay purchase which lead me to always insist on unwrapping any item i had to give a signature for before the delivery man's eyes! and b) not trusting registered mail as postman delivered a tampered registered mail envelope thorugh my post box without requesting any signature..0 -
Well, quick update on this - the seller did not respond until after Paypal had refunded my son the full amount. He then just said something like "this hasn't ever happened before..."
Still all's well now.0
