howver it appears you disagree with the position and you are dissatisfied with the offer that was made to you (no offer was made) we have therefore arranged a goodwill gesture of 75 pounds which is enclosed this means we have re paid the full amount of default charges which have been applied to your acount over the past 6 years (not had an account with them for past 6 years

The bank have informed you they do not agree with your complaint.
The bank have offered you £75 goodwill gesture.
I would cash the cheque (if for no other reasons than security). If you feel this is totally unacceptable, you could ask them how they would like the money they sent you back.
As regards your complaint itself, they have already informed you it is their final decision in the matter and suggested you refer it to the FOS if you are unhappy (who, based on what you have said, I suspect will also not uphold your complaint)
Personally, I suggest you take the £75 goodwill gesture they have provided in the spirit in which it was given; it's £75 more than than you had yesterday."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100

Ok firstly they will never admit they owe anything and any offer will be a 'goodwill gesture' since if they say they are refunding you the charges it implies that they are admitting there was something wrong with them in the first place.
They say that the £75 covers all the charges made on your account - is this correct? If so what is it that you are finding unacceptable about the offer, were you claiming interest back as well? If you are cashing the cheque make sure you write to them recorded saying that you are accepting the payment in partial settlement only, otherwise they could just say that taking the money was acceptance of the offer.
All the offers I have received from credit card companies have said final offer on them, but some have sent other offers since. If they do refuse to pay any more then would have to either accept the current offer, take to fos (although if it's interest only you are chasing might not get too far with them) or go the courts route (which I'm on at the moment).0

If you bank the cheque, you have accepted it in full and final settlement. This will close the case and the FOS will not proceed with it. You need to decide what you want to do, take it up with the FOS and rip the cheque up, or bank the cheque and have done with it.Best Regards
