Accident at work

The guy who had the accident is Still off work undergoing physio and his ssp runs out at the end of december. He has shown me a letter from his solicitor and the companies insurance have accepted 65% blame.
He has since spoken with his solicitor and accepts that he was to blame regarding stepping back off the ladder, But.....................in the letter sent by the companys advisers they state that "the work being carried out by the employee was at head height and could have been done standing on the floor" well that is a complete lie by the company and the guy has photographic proof that the work (spraying) was done well above head height, ie 4Mtrs.
He said when he spoke to his solicitor he was told that he should accept the 65% and to ignore the lie about the height of the work.

so if the companies insurance are saying that the company are liable for 2/3rds what payout have they offered if any?The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

As far as I can see/workout, the company have not given a sum as yet. He did say that his solicitor asked for proof of earnings for the 3 months previous to the accident and any monies paid to him (SSP) after the accident.0 -
Glad to hear the company is going to pay something but I was just wondering where the ladder came from? Has he never had to use a ladder before?0
